Applicant Obligations

If the visa application for a temporary visa is approved, the following conditions will apply to you.

Visa conditions

If your visa was granted to enable you to be employed in Australia, you must not do any of the following:

  • stop working for the employer who sponsored you for the visa either by becoming unemployed or changing employer
  • work in a position or occupation that is inconsistent with the position nominated
  • work for another person or for yourself while working for the sponsoring employer.
    Example: Undertaking secondary employment.

If your sponsor ceases your employment or activity, you must do one of the following:

  • find another employer who is willing to sponsor you; or
  • leave Australia within 28 days unless your visa expires before that time, in which case you must leave Australia prior to visa expiry.

Under a nomination arrangement you can change the nominated position or sponsor by having a new nomination approved.

You must maintain adequate health insurance whilst in Australia and holding a temporary resident visa.

Changing sponsor

If you decide to work for another organisation while in Australia you will need to be sponsored by the new organisation and have them lodge a nomination. When the new nomination is approved you will be able to work for that organisation for the period remaining on your visa without having to reapply for a new visa.

Taxation requirements

You must meet Australian taxation obligations if you work or engage in employment in Australia.

If you intend to engage in work or employment in Australia, you will need to read information on the Australian Taxation Office's website.

There may be other conditions of your entry and stay in Australia not discussed here. If so, these will be explained to you when you are granted the visa.

Secondary applicant obligations

A secondary applicant (family member):

  • can enter Australia with, or after you
  • can leave Australia with, or before you
  • must intend to remain a member of your family unit
  • must maintain adequate health insurance whilst in Australia and holding a temporary resident visa.

Secondary applicants must abide by all Australian laws.

Change in circumstances

If your circumstances change you must inform the department (in writing) as soon as possible.
