Nomination Eligibility - Non-Profit Engagements

The sponsor must lodge a nomination.

Nomination requirements

To nominate a position the sponsor should:

• have been approved as an entertainment sponsor
  or
• have already lodged an application to become an approved entertainment sponsor.

For a nomination to be approved:

• the nominated position must be for an entertainer to perform in one or more engagements for non-commercial purposes       
• an itinerary specifying the dates and venues for all performances is provided.

Salary or wages

The salary or wages payable to you must be in accordance with Australian labour laws and practices.

If there is no award, and it is not a volunteer position, you must receive at least the minimum federal award rate.

Unpaid position

A position is considered unpaid where the work or activity to be undertaken would not attract a salary or wage if undertaken by an Australian citizen or an Australian permanent resident. 

If the nominated position relates to a volunteer position the person will receive no remuneration for doing the work or activity other than reimbursement of reasonable expenses incurred by the person in doing the work.

Non-profit organisations

Non-profit organisations are often associated with engagements for non-commercial purposes.

Organisations should show that their non-profit nature has been accepted by the Australian Taxation Office (ATO) or a State/Territory government agency such as the NSW Department of Fair Trading.

Business entities are rarely involved in engagements for non-commercial purposes. Claims from a business that an engagement is for non-commercial purposes should be fully documented.

The organisation must meet Australian taxation obligations.

Supporting documentation

The sponsor must provide the following documentation with their nomination:

• evidence that the engagement(s) is for non-commercial purposes
• an itinerary of the engagements specifying dates and venues of performances.
