Exchange Visa (Subclass 411)
Nomination Eligibility
You must meet all of the following requirements to be eligible for this visa.
Nomination requirements
Sponsors must lodge a nomination to employ skilled workers from overseas. The nomination must provide details of the position and the skills, qualifications and experience required by the nominated person who will fill the position.
To nominate a position sponsors should:
- have been approved as an exchange sponsor
or - lodge an application to become an approved exchange sponsor.
For a nomination to be approved:
- the position is nominated by an approved exchange sponsor
- there is an exchange agreement between the applicant and an overseas organisation
- the proposed position is a skilled occupation
- the Australian resident who is party to the exchange will have the same position as held, or an equivalent position available on the completion of the exchange
- the nominated person has the experience and qualifications suitable to perform the duties of the nominated position.
Exchange arrangements
To nominate overseas workers the Australian organisation or government agency must have a written agreement in place with a reciprocating organisation overseas.
The nominating organisation is required to provide a letter from both their organisation and the reciprocating overseas organisation. The letters are to include:
- purpose of the exchange
- the name of the nominated person who is to work for the exchange sponsor
- the proposed skilled position, duties to be performed and the period of the exchange in Australia
- the name of the Australian citizen or Australian permanent resident who will be working in the reciprocating organisation overseas, that is party to the agreement
- the period that the Australian citizen or Australian permanent resident will be undertaking employment with the overseas organisation
- confirmation that the Australian citizen or Australian permanent resident will have the same position as held, or an equivalent position available on completion of the exchange
- how the exchange agreement will benefit both the nominated person and the Australian citizen or Australian permanent resident.
Skilled position
The nomination must be for a skilled position within your organisation. The position should provide for a graded skilled level, or a range of duties sufficiently broad to enable the nominated person to demonstrably add to or enhance their current skills in that occupation.
Salary or wages
The salary or wages payable to the primary sponsored applicant in relation to the proposed work is required to be in accordance with Australian labour laws and practices.
If there is no award, and it is not a volunteer position, the primary sponsored person is to receive at least the minimum Federal award rate.
