Step 1 - Employer requests to access a Labour Agreement

Employers or industry associations wishing to access a Labour Agreement must put forward a request that covers:
- the employer's background
- the industry background (where applicable)
- the type of skilled workers to be recruited from overseas
- efforts made to recruit from the local labour market
- their history of training Australian citizens and Australian permanent residents.
The request must be provided to the Australian Government, which is represented by:
- the Department of Immigration and Citizenship (DIAC)
and - the Department of Education, Employment and Workplace Relations (DEEWR).
An employer should send an email to the address below, indicating their interest in accessing a Labour Agreement. The department will send a questionnaire to the employer requesting them to provide certain specific details about their business, as broadly outlined above.

Additional information
If the Australian Government pursues a Labour Agreement with an organisation or industry association, that organisation or industry association will be required to provide more information on employment, education, training and industrial relations matters. Government representatives will invite the organisation or industry association to discuss the proposal.
The information provided by the employer does not guarantee that a Labour Agreement will be negotiated - organisations will also need to satisfy the requirements of the visa programs proposed for inclusion in a Labour Agreement.
The agreement becomes effective when it has been signed by the Department of Education, Employment and Workplace Relations, the organisation and the Department of Immigration and Citizenship and any other parties to the agreement. Copies are sent to the relevant parties.
The Director, Labour Agreement Section will be responsible for the management of the Labour Agreement. The Business Centre(s) identified in the agreement will be responsible for administering the processing of any visas applied for under the agreement.
