Identified Recruitment Agents for Chinese Skilled Workers


Australia and The People’s Republic of China have a Memorandum of Understanding in place that establishes an ethical framework for Chinese recruitment agents to supply Australian employers with skilled overseas workers.  Chinese recruitment agents must agree to the ethical framework, which requires that they not charge the skilled worker any fee for their services. All recruitment fees must be contained within the costs charged to their employer.  The recruitment agent must also agree to ensure that all documentation provided in support of a visa application (by or on behalf of an applicant) is genuine and verifiable.  Under the arrangements, they cannot subject the overseas worker to any financial or other unconscionable or material disadvantage.

Chinese recruitment agents who agree to abide by the ethical framework and are subsequently registered as ‘Identified Recruitment Agents’ by the Chinese Ministry of Commerce (MOFCOM) will have their agency listed both on this website and on the MOFCOM website.  Any recruitment agent who is found to have breached the ethical framework will be removed from the websites and may be subject to further penalties under Chinese law.

Australian employers

Question: How do I recruit Chinese Skilled Workers?
Answer: The Australian Government has signed an MOU with China to facilitate the ethical recruitment of temporary skilled workers from China.  The Identified Recruitment Agents, listed in the table above, have declared that they will not exploit workers or charge any fee to the worker for their services.  There is no obligation on Australian employers to use an agent on this list.

Question: What are the advantages of using an Identified Recruitment Agent?
Answer: Identified Recruitment Agents have declared that they will not exploit workers or charge any fee to the worker for their services.  This gives employers added assurance that their prospective employee will not be subject to any charges for the recruitment process.

Question: One of my employees has alleged that an Identified Recruitment Agent has requested payment for their service. What should I do?
Answer: You can advise your employee that they can lodge a complaint with this Department. The Department will contact them to discuss their complaint and request permission for employment details to be released to MOFCOM in order to investigate the allegation.

Question: Where can I find information about becoming a Subclass 457-Business (Long Stay) visa sponsor?
Answer: Information on sponsoring a skilled overseas employee to work for your business is available on the Department’s website.

Question: How do I find a recruitment agent that won’t charge me for placing me in a job in Australia?
Answer: The recruitment agents in the list above have signed a declaration saying that they will not charge potential employees for recruitment services.

Question: I have been charged a fee by an Identified Recruitment Agent for placing me in a job in Australia; what should I do?
Answer: You should lodge a complaint with the Department of Immigration and Citizenship.
