Definitions

Assurance of Support
Provide financial assistance to the applicant and any family members accompanying the applicant so they do not need to rely on any government forms of support for 2 years; and repay any recoverable social security payments made to the applicant or their accompanying family members in the first 2 years of settlement in Australia.
Australian mission
An Australian Embassy, High Commission, Consulate or Consulate-General or Australian Trade Commission.
Australian permanent resident
A non-citizen who, being usually resident in Australia, is the holder of a permanent visa.
Centrelink
Centrelink is the government department responsible for making social security payments in Australia.
Close Relative
In relation to a person, means:
  1. the spouse of the person; or
  2. a child, adopted child, parent, brother or sister of the person; or
  3. a step-child, step-parent, step-brother or step-sister of the person.
Dependent child
A dependent child means the natural or adopted child, or step-child, of a person (other than a child who has a spouse or is engaged to be married), being a child who:
  1. has not turned 18; or
  2. has turned 18 and:
    1. is dependent on that person; or
    2. is incapacitated for work due to the total or partial loss of the child's bodily or mental functions.
Dependant
A person who is wholly or substantially reliant on the other person for financial support to meet their basic needs of food, shelter and clothing; or wholly or substantially reliant on the other person for financial support due to their being incapacitated for work because of the total or partial loss of bodily or mental functions.
Eligible New Zealand Citizen
A New Zealand citizen who at the time of their last entry to Australia would have met their health and character checks and:
  • held a Subclass 444 (Special Category) visa on 26 February 2001; or
  • held a Subclass 444 visa that was in force for more than a year before 26 February 2001; or
  • has a certificate, issued under the Social Security Act 1991, that states the citizen, for the purposes of the Migration Act, was residing in Australia on a particular date.
Guardian
In relation to a child, means a person who:
  1. has responsibility for the long-term welfare of the child; and
  2. has, in relation to the child, all the powers, rights and duties that are vested by law or custom in the guardian of a child, other than:
    1. the right to have the daily care and control of the child; and
    2. the right and responsibility to make decisions concerning the daily care and control of the child.
Settled
A person is considered settled if they are an Australian citizen, Australian permanent resident or an eligible New Zealand citizen who is lawfully resident in Australia for a reasonable period. In normal circumstances, 2 years is considered to be a reasonable period. For Australian citizens this period may be reduced to at least three (3) months.
Sponsor
A person who provides support to the applicant and any accompanying family members during their first two (2) years of residence in Australia, including accommodation and financial assistance to meet living costs, as required. Generally, for the purposes of parent migration, the sponsor is the child of the applicant.
Spouse
The person you are married to, or in a de facto relationship with. You are in a de facto relationship if you have been living with a person of the opposite sex for at least 12 months immediately prior to the date of application, and the department is satisfied that you have a genuine, exclusive and continuing relationship.
Step-child
A natural or adopted child of your current spouse or a natural or adopted child of your former spouse who is under 18 and you have a legal responsibility to care for them.
