Dear Sir/Madam,

Malcolm Brown's piece (Desperately seeking a new life, but left stranded by shonks, 7 December 2001) raises several issues that I would like to clarify.

Paying a migration agent $40,000-$50,000 is not a guarantee of a desired outcome on a visa application.

The Department of Immigration and Multicultural and Indigenous Affairs does not require its clients to use a migration agent.

However, anyone who chooses to do so is advised to check the agent's professional credentials and in particular whether they are registered.

Registered migration agents are required to meet stringent entry standards to be able to practice and must complete continuing professional development activities prior to annual re-registration.

Importantly, they must also abide by a Code of Conduct. Those who do not may be subject to disciplinary action including cancellation or suspension of their registration.

Furthermore, it is a criminal offence to provide immigration assistance without registration and is subject to severe penalties (up to 10 years imprisonment).
