Employer Obligations
It is a criminal offence under the Migration Act 1958 for a person to knowingly or recklessly allow an illegal worker to work or refer an illegal worker for work with another business.
This information is to help Australian employers understand their obligations and to assist them in complying with the law. Instructions and advice is provided about checking the work entitlements of Australian citizens, permanent residents and visa holders who are in the country temporarily and may not be entitled to work in Australia.
