Changes to lodgement and processing arrangements for Occupational Trainee (Subclass 442) visas

Client summary
From 9 November 2009, the Migration Regulations 1994 ('the Regulations') are amended to require all Occupational Trainee (Subclass 442) visa applications, including those lodged by clients who are outside Australia, to be posted or delivered by courier service to an address specified by the Minister in an instrument in writing. The address specified by the Minister is the Adelaide Occupational Trainee Processing Centre (AOTPC).
The amendments further provide that Occupational Trainee visa applicants can be outside or in Australia (but not in immigration clearance) at the time of grant of the visa, regardless of where they were when they lodged their visa application.Affected legislation
The following provisions of the Regulations are amended:
- Schedule 1 - Paragraphs 1208 (3) (a) and (b) are amended
- Schedule 1 – Paragraph 1208(3)(bd) is inserted
- Schedule 2 - Division 442.21 note, clauses 442.227 and 442.228, subclause 442.229 (1), clauses 442.312, 442.324 and 442.324A, and Division 442.4 are amended.
Additional information
The consolidation of all Occupational Trainee visa applications, and all sponsorship and nomination applications relating to Occupational Trainee visas, in one location will enable the consolidation of expertise thereby increasing efficiency and consistency and delivering improved client service.
Enabling the grant of an Occupational Trainee visa to a client who is in or outside Australia, regardless of where the client was when they lodged their application, will provide greater flexibility for clients.
Transitional provisions
The changes apply to all Occupational Trainee (Subclass 442) visa applications lodged on or after 9 November 2009. All Occupational Trainee visa applications lodged prior to that date will be processed as per current arrangements.
Forms
Form 147 will be amended to reflect these changes by 9 November 2009.
