Minor technical amendments to permission to work arrangements for Protection visa and Ministerial intervention applicants

Client summary
On 1 July 2009, the Migration Regulations 1994 (‘the Regulations’) were amended to put into place new permission to work arrangements for Protection visa applicants and clients seeking Ministerial intervention.
Following implementation, some operational issues were identified. These amendments are intended to improve the operation of the Subclass 050 – Bridging (General) Visa, and also include some minor technical amendments.
Affected legislation
The following provisions in Schedule 2 are amended:
- subclause 050.212(1);
- paragraph 050.212(6B)(a);
- subclause 050.612A(1);
- clause 050.614; and
- subclause 050.615(1)
The following provisions in Schedule 2 have been inserted:
- subclause 050.212(5B); and
- subclause 050.212(6B).

Application of the new provisions
The amendment to subclause 050.212(1) will be retrospective and taken to have commenced on 1 July 2009.
The remaining amendments will commence on 14 September 2009 and apply to Bridging visa E (subclass 050) applications lodged on or after that date.
