Amendments to the Migration Regulations 1994 in relation to approving electronic forms and the use of an electronic form for visa applications under the Approved Destination Scheme

From 1 July 2009, the Migration Regulations 1994 ('the Regulations') are amended to allow electronic forms to be used. In particular, visa applications for a Subclass 676 (Tourist) visa under the Approved Destination Status Scheme will be able to be lodged using an electronic form 48G.

Affected legislation

The following provisions of the Regulations are amended:

Subparagraph 1.18(2)(b)(ii) is amended
Subparagraph 1.18(2)(b) is inserted
Schedule 1, Subparagraph 1218(1)(b)(iv) is amended

Additional information: The amendments provide that an approved form includes a set of questions in a form that is stored in an electronic format and approved by the Minister for making a visa application.  The amendments specifically allow for a new electronic form 48G, which, subject to approval by the Minister, can be used for making visa applications for a Subclass 676 (Tourist) visa under the Approved Destination Status Scheme.

Transitional provisions: The amendments apply in relation to visa applications made on or after 1 July 2009, and made, but not finally determined, before 1 July 2009.

Forms: A new electronic form 48G will, subject to approval by the Minister, be available to approved travel agents under the Approved Destination Status Scheme.
