Extension of entry period for Subclass 462 (Work and Holiday) visa holders

Client summary

From 1 July 2009, the Migration Regulations 1994 ('the Regulations') are amended to provide that Subclass 462 (Work and Holiday) visa holders, whose visas are granted while the persons are outside Australia, have twelve months to enter Australia after their visas are granted. Currently, the Regulations provide that Subclass 462 visa holders must enter Australia within three months of visa grant. This change will provide Subclass 462 visa holders with extra time to arrange their affairs before travelling to Australia.

The change will apply to Subclass 462 visas granted on or after 1 July 2009, to people who are outside Australia at the time of grant. Subclass 462 visa holders whose visas are granted outside Australia, before 1 July 2009, must enter Australia within three months of the grant of the visa.

Affected legislation

The following provisions of the Regulations are amended:

Schedule 2, paragraph 462.511(a) is amended.

Additional information: Nil.

Transitional provisions: The amendments apply to applications for a Subclass 462 visa:

  • made, but not finally determined (within the meaning of subsection 5(9) of the Migration Act 1958) before 1 July 2009, or
  • made on or after 1 July 2009.

Forms: Form 1208 and 1208e will be amended to reflect these changes.

Instructions: PAM3: Sch2Visa462 will be amended to reflect these changes by 1 July 2009.
