Amendments to the Work and Holiday Visa Programme

Client summary
From 22 October 2007, the Migration Regulations 1994 (‘the Regulations’) are amended to:
- correct a minor typographical error in the values statement public interest criterion number in the time of decision criteria for a Work and Holiday visa.
From 31 October 2007 the Regulations are amended to:
- give effect to an arrangement with the USA that allows persons who hold a valid passport from the USA to make internet or paper applications for a Work and Holiday visa
and - change when discretionary conditions may be imposed on Work and Holiday visas.

Transitional provisions:
In relation to the requirements for making a Work and Holiday visa application, the amendments apply to an application for a Work and Holiday visa made on or after 31 October 2007.
In relation to the conditions, the amendments apply to an application for a Work and Holiday visa made but not finally determined before 31 October 2007 and applications made on or after 31 October 2007.
In relation to the typographical error, the amendments apply to an application for a Work and Holiday visa made in the period starting 15 October 2007 and ending 21 October 2007 but not finally determined by 22 October 2007 and applications made on or after 22 October 2007.

Instructions: PAM3 The PAM3:SchVisa 462 Policy Guidelines will be amended to reflect these changes.
