Client summary
From 15 October 2007 the Migration Regulations 1994 ('the Regulations') are amended to attach Public Interest Criterion 4003 (PIC 4003) to Subclass 771 (Transit) visas.
PIC 4003 allows a visa to be refused where the Foreign Minister, or a person authorised by the Foreign Minister, has determined the applicant to be a person whose presence in Australia:
- is, or would be, contrary to Australia's foreign policy interests; or
- may be directly or indirectly associated with the proliferation of weapons of mass destruction.
The amendment will allow a Transit visa to be refused if, for example, the applicant is subject to travel sanctions.

The following provisions of the Regulations are amended:
Clause 771.222 of Schedule 2.

Transitional provisions: This amendment applies to applications for Transit visas made on or after 15 October 2007.
Forms: Form 876 - Application for Transit visa for Australia (subclass 771).
Instructions: PAM3 has been amended to reflect these changes.
