Contributory Parent Visa Amendments

Client summary
From 10 September 2007, amendments will be made to the Migration Regulations 1994 in relation to temporary and permanent Contributory Parent visas.
The amendments allow applicants who have held a temporary contributory parent visa at any time since last entering Australia to be able to apply for a wider range of visas if they are outside Australia.
The amendments also result in certain applicants for permanent contributory parent visas who:
- have held a temporary contributory parent visa at any time in the 28 days immediately
before applying
or - have held a temporary contributory parent visa and for whom compassionate and compelling circumstances exist
to be considered to be the holder of a temporary contributory parent visa at the time of application to allow them to benefit from lower visa application charges and less stringent criteria for the grant of a permanent contributory parent visa.
Technical Details
The amendments involve the following:
- amending subregulations 2.07AI(1) and (2) in relation to applying for a wider range of visas if outside Australia
- amending subitem 1130(2) of Schedule 1 in relation to visa application charges for a Contributory Parent (Migrant) (Class CA) visa
- inserting new subitem 1130(5) in Schedule 1, which expands what is meant by references to being the holder of a Subclass 173 (Contributory Parent (Temporary)) visa
- amending subitem 1130A(2) of Schedule 1 in relation to visa application charges for a Contributory Aged Parent (Residence) (Class DG) visa
- inserting new subitem 1130A(5) in Schedule 1, which expands what is meant by references to being the holder of a Subclass 884 (Contributory Aged Parent (Temporary)) visa
- inserting new clause 143.111 in Part 143 (Subclass 143 (Contributory Parent)) of
Schedule 2, which expands what is meant by references to being the holder of a
Subclass 173 (Contributory Parent (Temporary)) visa
and - inserting new clause 864.111 in Part 864 (Subclass 864 (Contributory Aged Parent)) of Schedule 2, which expands what is meant by references to being the holder of a Subclass 884 (Contributory Aged Parent (Temporary)) visa.

Transitional arrangements:
The amendments apply in relation to an application for:
- a Contributory Parent (Migrant) (Class CA) visa
- a Contributory Aged Parent (Residence) (Class DG) visa
made on or after 10 September 2007.
Forms: Form 1129, Booklet 3 Parent Migration, will be amended to reflect the changes.
