Amendment to the Health Service Provider in Regulation 1.15AA

From 23 April 2007, Regulation 1.15AA in the Migration Regulations 1994 (‘the Regulations’), will be amended to remove the reference to Health Services Australia (HSA). Instead, the regulation will provide that a health services provider, for the purpose of issuing a certificate under regulation 1.15AA, is a health services provider specified by the Minister in an instrument.
HSA, a government business enterprise, has been contracted to provide Onshore Medical Services (OMS) for the Immigration Programme since its creation in 1997. The Onshore Medical Services were put to tender on 9 August 2006, and the Department of Immigration and Citizenship is currently in contract negotiations with the preferred provider. The proposed dates for the contract are 25 May 2007 to 24 May 2012.
This change to a generic provider specified by the Minister in an instrument will avoid the need to further amend the Regulations should the health service provider change in future contracts.
Technical details
In regulation 1.15AA(2), the phrase ‘a medical service provider specified by the Minister in an instrument in writing’ is substituted for the reference to Health Services Australia.
The definition of Health Services Australia is removed from regulation 1.15AA (4).
