Registered Migration Agents to Certify Documents Relating to Visa Applications

Client summary

From 1 October 2006 the Migration Regulations 1994 ('the Regulations') will be amended to provide that registered migration agents, in Australia and outside Australia, may certify copies of original documents that relate to visa applications, provided that their registration is not currently suspended and they are not subject to a caution that is in effect.

Technical details

Subparagraph 2.13(5)(b)(iv) in Part 2 of the Regulations will be amended.

Additional information: The previous provision of subparagraph 2.13(5)(b)(iv), relating to certifying documents outside Australia, is retained. A person who is the equivalent of a Justice of the Peace or a Commissioner for Declarations may also certify copies of original documents overseas
