Amendments to Regulation 3.10. Amendments to provisions related to the use of information regarding persons on international flights

Client summary
From 1 October 2006, the Migration Regulations 1994 will be amended to provide that where the Commonwealth has entered into an agreement with an international air carrier, information about persons on international flights or movements of air traffic may be provided to the air carrier if the Minister is satisfied that the provision of that information will facilitate the handling of aircraft or of persons traveling to destinations outside Australia.
Details of the agreement entered into with air carriers under these arrangements must be published in the Gazette.
The amendments will, in conjunction with an agreement and the consent of the Minister, enable the Department to provide information about passenger and crew to airlines and foreign countries to facilitate air travel to destinations outside Australia.
Technical details
The following provisions of the Migration Regulations 1994 will be amended:
- Subregulation 3.10(3)
- Subregulation 3.10(3A) (new paragraph)
- Subregulation 3.10(4)
- Subregulation 3.10(5)
