Amendments to Bridging Visa E

Client summary

From 26 July 2005, the Migration Regulations 1994 will be amended to provide that persons seeking:

  • a declaration from a court that the Migration Act 1958 does not apply to the person; or
  • merits or judicial review of a decision made pursuant to the Australian Citizenship Act 1948;
are eligible to be granted a Subclass 050 Bridging (General) visa to allow them to remain lawfully in Australia while awaiting the outcome of proceedings. The applicant's immediate family members would also be eligible for a Subclass 050 Bridging (General) visa. Subclass 050 Bridging (General) visa is a subclass within Bridging E (Class WE).

Technical details

The following provisions of the Migration Regulations 1994 have been amended:

  • Subclause 050.212(1) amended.
  • New subclause 050.212(4AAA) inserted after subclause 050.212(4).
  • New subclause 050.212(4AB) inserted after subclause 050.212(4AA).
  • Subclause 050.212(4A) amended.
  • Subclause 050.222(1) amended.
  • Subclause 050.222(3), note amended.
  • Paragraph 050.511A(b) amended.
  • New clauses 050.511B, 050.511C, 050.511D and 050.511E inserted after clause 050.511A.
  • New clause 050.612B inserted after clause 050.612A.
