Amendment to Migration Regulations 1994 - Personal Identifiers

Client summary
From 1 July 2005, immigration law has been amended to:
- add to the range of personal identifiers that may be collected from non-citizens in immigration clearance and in immigration detention
- allow for the disclosure of identifying information to selected international organisations and law enforcement, border control, intelligence and security bodies of the Commonwealth, States and Territories.
Technical details
The following provisions of the Migration Regulations 1994 have been amended:
- New regulation 3.03A inserted after regulation 3.03
- Regulation 3.30 amended
- New regulations 5.34D and 5.34E inserted after regulation 5.34.
Additional information:
- The law enforcement, border control, intelligence and security bodies of the Commonwealth, States and Territories to be prescribed under new regulation 5.34D will be specified by the Minister in a new Gazette Notice.
- The international organisations to be prescribed under new regulation 5.34E will be specified by the Minister in a new Gazette Notice.
Transitional arrangements: These amendments apply to:
- Requests for personal identifiers made in accordance with the Migration Act 1958 on or after 1 July 2005
- Disclosures of identifying information in accordance with the Migration Act 1958 on or after 1 July 2005.
