Electronic Lodgment of Class DD, DE and UX Visas

Client summary
The purpose of the amendments to the Migration Regulations 1994 (the Principal Regulations) is to enable an applicant for certain classes of skilled visas to make a visa application either using a paper application form or electronically using an Internet application form, by:
- specifying the manner in which an Internet application may be made;
- amending visa application validity requirements for certain Skilled Migration visas to require an applicant to make a declaration that they have met certain requirements, such as applying for an Australian Federal Police check or undertaking a health assessment, to facilitate electronic processing of visa applications; and
- making amendments to visa grant criteria for certain Skilled Migration visas to verify that the matters declared by applicants in their application are correct, and that the results of certain requirements are satisfactory.
Technical details
Amendments have been made to Schedule 1 and Schedule 2 relating to Skilled - Independent Overseas Student (Residence) (Class DD), Skilled - Australian-Sponsored Overseas Student (Residence) (Class DE) and Skilled - Independent Regional (Provisional) (Class UX) visas.
Additional information: The introduction of electronic lodgment for Class DD, DE and UX visas will improve client accessibility and result in efficiency gains for the Department.
Transitional arrangements: The new Regulations apply to an application made on or after 1 July 2005.
Forms: 47SK, 47SK (Internet), 40, 40 (Internet).
Instructions: PAM3 will be updated for Subclass 495, Subclass 880, Subclass 881 and Subclass 882 and Schedule 6A.
Migration Series Instructions 160 & 254 will be amended at a future date to reflect repeal.
Effect on delegations: Nil.
Effect on systems: ICSE has been modified to accept applications lodged electronically.
