Technical details

Item [1] - Subregulation 4.31B(5) restricts the application of regulation 4.31B to the review of an RRT-reviewable decision where the application for review was made on or after 1 July 1997 and before a certain date. It is effectively a "sunset provision".

This item removes the sunset clause in subregulation 4.31B(5). The effect of the amendment is that all applications for review to the Refugee Review Tribunal after 1 July 2005 are subject to subregulation 4.31B(1)(b) which imposes a $1400 post Refugee Review Tribunal decision fee on unsuccessful review applications.
