Student Visa Changes - Technical Amendments
2 April 2005 - Legislation change
Client summary
From 2 April 2005 technical changes have been made to the student visa regulations in order to clarify the intended requirements of the legislation.
Technical details
Member of the Family Unit
The words "a family member" have been replaced with "a member of the family unit" wherethey appear in the regulations for making a valid student visa application. This has been done to ensure that the student visa regulations are consistent in their reliance on the term "member of the family unit" (which is defined elsewhere in the Migration Regulations).
Affected Legislation: Schedule 1, subparagraph 1222(2)(a)(i).
Course of Study
A definition of course of study has been inserted in subclass 570 (Independent ELICOS) to make clear that the requirement for a course to be full-time and CRICOS-registered applies to all student visa subclasses.
Affected Legislation: Schedule 2, clause 570.111.
Foundation Course
The definition of foundation course has been relocated so that all defined terms in Schedule 5A are in the correct alphabetical order. It now appears after the definition of first 36 months.
Affected Legislation: Schedule 5A, clause 5A101.
Other Technical Amendments
Amendments have been made to Schedule 5A304 to correct a grammatical error and to ensure that the terms used are defined consistently. Amendments have been made to Schedule 5A509(b)(ii) to correct an earlier drafting error.
Affected Legislation: Schedule 5A, subparagraph 5A304(1)(c)(ii), Schedule 5A, subparagraph 5A304(8)(a)(vii)(A), Schedule 5A, subparagraph 5A304(8)(b)(vii)(A), Schedule 5A, subparagraph 5A304(8)(a)(viii)(A), Schedule 5A, subparagraph 5A304(9)(b)(ix)(A) and Schedule 5A, subparagraph 5A509(b)(ii)..
