Subclass 832 Close Ties - policy change for applicants who meet the subclass 151 Former Resident criteria

From 1 November 2003, immigration law has been amended to clarify policy intention that a person who is the holder of a substantive visa, other than a subclass 771 (Transit) visa, may also be eligible for the grant of a subclass 832 (Close Ties) visa if they satisfy the criteria to be satisfied at time of application for a subclass 151 (Former Resident) visa.

Technical details

Additional information: regulation 832.212(6) has been inserted into the Regulations to implement the above-mentioned policy, whilst the following provisions are technical amendments that have been amended - 832.212(5), 832.212(6), 832.221(4)(a) as a result of inserting 832.212(6).

Transitional arrangements: the changes apply to applications made on or after 1 November 2003.

Forms: changes have been made to the November 2003 edition of the Booklet 8, Special Migration, including the form 47SV, Application for Special Migration to Australia.

Instructions: PAM3: Sch2Visa832 guidelines have been updated.
